FreeTrak SA (PTY) LTD ( “Freetrak”)
The FreeTrak Customer Service Agreement includes the Freetrak terms and Conditions, Operating Instructions and Privacy Policy as available on the Freetrak website (www.freeTrak.co.za) or by contacting FreeTrak on 011 025 0495
- The FreeTraK service agreement is between you, the customer, and FreeTraK.
- FreeTraK agrees to provide the FreeTraK service on the FreeTraK terms, and you agree to the FreeTraK terms.
- You warrant that you are the owner of the vehicle or that you are authorized to enter into this agreement on behalf of the owner.
- You undertake to inform any other driver of the vehicle that the vehicle is tted with a FreeTraK product.
- You warrant keeping your online user name; passwords and the FreeTraK product cell number a secret.
- You undertake to recharge your prepaid FreeTraK product via internet banking or ATM whenever necessary, and that it is not the responsibility of FreeTraK to recharge your FreeTraK Product.
- Data communication and LBS positioning is through a partnership with MTN, the country's leading GSM network providers, with the widest coverage, you warrant not to hold FreeTraK responsible for any communication breakdowns due to network failures.
- You warrant to keeping at least two lines of defense active on your FreeTraK product at all times, as recommended by FreeTraK.
- You warrant paying a fee of R200 per year to FreeTraK, for upgrades and maintenance of your online services and servers.
- Your online prole will be suspended if you do not wish to pay the annual maintenance fee, however you will still have full access and functionality of cell phone based commands.
- You indemnify and hold FreeTraK harmless against any claims, costs, damages or losses as a result of the breach of these warranties and/or undertakings.
- You warrant to paying fees of R750 per hour should you require FreeTraK agents to recover your vehicle in addition to towing, storage and other recovery related costs where necessary.
- You indemnify and hold FreeTraK harmless against any claims, costs, damages or losses as a result of negligence or misuse.
- FreeTraK does not warrant that your stolen vehicle will be found.
- FreeTraK only accepts liability for gross negligence or willful misconduct.
